By accessing or using Nexth Escrow services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.
2. Service Description
Nexth Escrow provides a peer-to-peer escrow payment platform that holds funds securely until transaction conditions are met between buyers and sellers. We act as a neutral third party to facilitate safe online transactions.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding agreements. By registering, you represent and warrant that you meet these requirements.
4. Account Registration
- Provide accurate, current, and complete information
- Maintain the security of your login credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
5. Transaction Terms
Buyer Obligations:
- Deposit funds into escrow promptly
- Inspect goods/services within the inspection period
- Release funds or open disputes within specified timeframes
Seller Obligations:
- Deliver goods/services as described
- Provide valid tracking/delivery confirmation
- Respond to disputes within 48 hours
6. Fees & Payments
- A transaction fee applies to each successful escrow (see fee schedule)
- Fees are automatically deducted upon fund release
- All fees are non-refundable except in cases of platform error
- Payment disputes may incur additional processing fees
7. Prohibited Activities
You may not use our platform for:
- Illegal goods or services
- Money laundering or fraudulent activities
- Weapons, drugs, or regulated substances
- Items violating intellectual property rights
- Any transaction prohibited by law
8. Dispute Resolution
- Contact the other party first to resolve issues
- File disputes within the 14-day inspection period
- Provide clear evidence (photos, communications, tracking)
- Our team will review and mediate within 5 business days
- Binding decisions are final unless appealed within 72 hours
9. Limitation of Liability
Nexth Escrow is not liable for:
- Quality or condition of goods/services exchanged
- Delays caused by third-party payment processors
- Losses exceeding the escrowed amount
- Indirect, incidental, or consequential damages
10. Intellectual Property
All platform content, logos, and software are owned by Nexth Escrow. You may not copy, modify, or distribute without explicit permission.
11. Termination
We reserve the right to suspend or terminate accounts for:
- Violation of these terms
- Suspected fraudulent activity
- Failure to respond to disputes
- Inactivity for over 12 months
12. Modifications
We may update these terms periodically. Continued use after changes constitutes acceptance. Significant changes will be notified via email.
13. Governing Law
These terms are governed by the laws of Hong Kong. Disputes will be resolved through binding arbitration in Hong Kong.
